The Breakpad Ltd - Bike Hire Agreement

Mountain biking is an exciting activity that comes with risks. In order to minimize these risks, we advise you to listen carefully to our member of staff who will take you through how to operate the bike and if asked, we will give you a recommended route to take.

Misuse or abuse of any hire equipment will result in termination of the hire agreement and the immediate return of the equipment. The Breakpad staff reserve the right to refuse hire or request hire equipment to be returned at anytime with a full or partial refund.

PAYMENT for hiring is due in full to confirm the bikes. Delays in returning rental bikes will be charged for another half day.

CANCELLATION – within 24 hours, full charge. Within 1 week 50% cancellation charge. In the unlikely event that we have to cancel your hire or make repairs, we will notify you as soon as possible and offer you the choice of an alternative or a full refund.

LOSS AND DAMAGE DEPOSIT – You are responsible for the bike and the equipment and will be liable for any loss or damage to the bike or equipment. You will be liable to pay in full the cost of any loss or damage of the bike/equipment. Any damage will be charged for at cost price.

Photo ID (drivers license or passport) will be required and retained during hire period – and redeemable upon return of the bike in full working order. NO ID = NO HIRE Hire fees include a helmet. We can also provide; lock, pump, inner tube, tools and saddle bag.

HELMETS are mandatory, if you do not have one you will be required to hire one. No bike will be hired without a helmet (either your own or hired).

You must ride with a helmet at all times.

Bikes must not be left unattended at any time.

Bike familiarisation - You will be given the opportunity to familiarise yourself with our bikes and a member of staff will be on hand to assist you. Acknowledgement of this document determines that you will do this. Visitors to the forest are asked to read and follow the Scottish Outdoor Access Code (SOAC).

ELECTRIC BIKES / ebikes - The hirer acknowledges it is against the law for a person who is 14 years old or younger to ride an ebike on roads, or on cycle paths and anywhere else pedal bikes are allowed, and that the hirer or anyone in his/her group is 15 years old or above and will not allow anyone who is 14 years old or below to ride an ebike hired out by The Breakpad on roads or on cycle paths and anywhere else pedal bikes are allowed.

Force Majeure- Except where otherwise expressly stated in these booking conditions, The Breakpad Ltd cannot accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by "force majeure". For the purposes of these booking conditions, "force majeure" means any event which we, our employees, agents or supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

Complaints- If you have a problem with our services, you should report it immediately to us so that the matter can be put right. Any ensuing complaints should be notified to us as soon as reasonably practical and in any event put in writing to us within 28 days of the end of your hire.

Liability- for injury or loss. We will not be liable for any injury or loss suffered by you except in the following circumstances:

1. Death or personal injury caused by the negligence of us, our employees, agents or suppliers provided they were at the time carrying out work authorised by us

2. Misrepresentation made by us, our employees, agents or suppliers provided they were at the time carrying out work authorised by us.

3. Breach of our contractual duty to exercise due diligence in making arrangements for your visit and for consequential loss arising from any such breach.

4. Failure to provide contractual services which are adequate or are of a reasonable standard.

Insurance The Breakpad Ltd strongly recommends that you are adequately insured for your hire although cover is not mandatory.

Under the Data Protection Act, no personal information will be given to any other agencies, except if you book your bike into the Scotland Cycle Repair Scheme, in which case your name and email address will be given to CyclingUK in order for them to contact you in 3 months time to ask for your feedback.
